론 와이든(Ron Wyden) 상원의원은, 702조(Section 702)에 대한 비밀 해석이 언젠가 기밀해제되면 미국 대중은 NSA가 무엇을 해왔는지 알고 “경악”하게 될 것이라고 말한다. 와이든의 정치 경력을 따라온 사람이라면, 이 사람이 과장을 즐기는 인물이 아니라는 것—그리고 이런 경고에서 그의 전적이 완벽하다는 것을—알고 있다.
불과 지난달, 우리는 와이든 사이렌에 대해 썼다. 이는 론 와이든 상원의원이 분류(기밀)라는 장막 뒤에서 끔찍한 일이 벌어지고 있다는 것을 암호 같은 공개 신호로 알리되, 무엇인지 말할 수는 없고, 그러고 나서 결국에는 그가 옳았음이 입증되는 패턴을 뜻한다. 매번 그랬다. 당시의 촉발점은 CIA 국장 Ratcliffe에게 “CIA 활동에 대한 깊은 우려”를 표명한 두 문장짜리 서한이었다.

그는 옳다. 재승인이 논의될 때마다 실질적인 토론은 일어나지 않는다. 그리고 승인 시한이 끝나기 직전에, 의회 내 감시 옹호 진영의 충성스러운 병사 누군가가 “국가안보”를 목이 터져라 외치며, 토론할 시간이 없고 이러다 사람들 죽는다고 우기고, 몇 년만 더 재승인해 주면 그때 감시에 대한 토론을 할 수 있다고 약속한다.
그 토론은 결코 오지 않는다.
하지만 와이든이 말할 수 없는 비밀 해석을 잠시 제쳐두더라도, 그의 연설은 거의 그만큼 치명적인 또 다른 사실을 부각한다. 지난 재승인에서 이뤄졌다고 주장된 “개혁”이 얼마나 처참하게 실패했는지다. 기억하겠지만, 지난 재승인을 통과시키기 위한 큰 “양보” 중 하나는 “민감한 조회(sensitive searches)”—선출직 공직자, 정치 후보자, 언론인 등을 겨냥하는 조회—에는 FBI 부국장(Deputy Director)의 승인이 필요하다는 요구였다.

하지만 보기보다 더 심각합니다. FBI는 부국장이 검토한 모든 민감한 조회를 추적하는 것조차 거부해 왔습니다. 감찰관(Inspector General)은 FBI에 이 정보를 간단한 스프레드시트에 넣기만 하라고 권고했지만, 그들은 그렇게 하기를 거부했습니다. 이것이 바로 FBI가 얼마나 감독을 원치 않는지 보여 줍니다.

와이든은 이전 행정부의 비밀 약속이 정확히 ‘아무 가치도 없다’는 점을 올바르게 지적한다.
하지만 또 하나가 있습니다. 바이든 행정부가 이 광범위하고 통제되지 않는 권한을 절제해 사용하겠다고 어떤 비밀 약속을 했든, 현 행정부는 분명 그 약속에 구속된다고 느끼지 않을 것입니다. 따라서 이전 행정부가 그 조항으로 무엇을 이루려 했든, 현 행정부가 케이블 수리공과 기술지원 인력을 징집해 미국인을 비밀리에 염탐하게 하는 것을 막을 수 있는 것은 아무것도 없습니다.
정리하자면 이렇다. 의회는, 와이든이 ‘언젠가 공개되면 대중이 경악할’ 것이라고 말하는 비밀 법 해석을 가진 채로 702조 재승인 표결을 앞두고 있다. “개혁”은 감시 승인 권한을 음모론자들에게 쥐여 줬고, 그들은 스프레드시트 하나도 남기지 않으려 한다. 정부를 돕도록 강요될 수 있는 사람의 정의는 대폭 확대됐다. 절제하겠다는 비밀 약속은 현 행정부가 지킬 의도가 없다. 그리고 NSA 수장 지명자는 헌법을 따르겠다고 약속하려 하지 않는다.
와이든 사이렌이 요란하게 울리고 있다. 그리고 역사가 길잡이라면—예외 없이 늘 그랬듯이—분류(기밀)라는 장막 뒤에 있는 것은 우리가 바깥에서 볼 수 있는 것보다 더 나쁘다.

…좋은 정서이긴 하지만, 의회는 우리의 자유보다 자기들 의제에 별 관심이 없다.
그러니 와이든은 수십 년 동안 NSA와 거대한 감시 국가를 통제하는 데 완전히 무능했다.
우리 미국식 대의민주주의 모델에는 큰 결함이 있는 듯하다.
